Terms of Service
These terms explain how you may use the Carduu service.
Effective date: January 1, 2025
Article 1. Purpose
These Terms of Service define the conditions, procedures, rights, obligations, and responsibilities between Carduu (the "Company") and users for the invitation and survey creation service provided by the Company (the "Service").
Article 2. Definitions
The terms used in these Terms have the following meanings:
- "Service" means the invitation, survey creation, and sharing services provided by the Company.
- "User" means a member or non-member who accesses the Service and uses the Service under these Terms.
- "Member" means a person who registers an account by providing personal information and can continuously use the Service.
- "Non-member" means a person who uses the Service without registering as a member.
Article 3. Notice and Changes to Terms
- The Company posts these Terms and required business information where users can easily review them.
- The Company may amend these Terms within the scope permitted by applicable laws, including laws on terms and conditions and information network protection.
- When the Company amends these Terms, it will announce the effective date and reason for the amendment from 7 days before the effective date until the day before the effective date.
Article 4. Service Provision and Changes
- The Company provides the following services:
- Invitation template and editing services
- Survey template and editing services
- AI-based automatic template generation
- Card sharing and response collection
- Response data analysis and statistics
- Other services designated by the Company
- The Company may change all or part of the Service when operational or technical needs require it.
- If service content, use methods, or available times change, the Company will announce the reason, changed content, and effective date before the change takes effect.
Article 5. Service Suspension
- The Company may temporarily suspend the Service due to system maintenance, replacement, failure, communication interruption, or similar causes.
- If a suspension under the previous paragraph causes damage to a user or third party, the Company will compensate for that damage unless the Company proves that it was not intentional or negligent.
Article 6. Membership Registration
- A user applies for membership by entering required information in the registration form and indicating agreement to these Terms.
- The Company will approve membership unless the applicant has previously lost membership under Article 7, provided false or incomplete information, or the Company determines that registration would cause significant technical difficulty.
- The membership agreement is formed when the Company's approval reaches the user.
Article 7. Withdrawal and Loss of Membership
- A member may request withdrawal at any time, and the Company will process the withdrawal without delay.
- The Company may restrict or suspend membership if a member provides false registration information, interferes with another person's use of the Service, misuses another person's information, or uses the Service in a way prohibited by law or these Terms.
- If the same conduct repeats at least twice or is not corrected within 30 days after membership restriction or suspension, the Company may terminate membership.
Article 8. Notices to Members
- The Company may notify a member using the email address designated by the member.
- For notices to many or unspecified members, the Company may replace individual notice by posting the notice in the Service for at least 1 week.
Article 9. Privacy Protection
- The Company collects only the minimum personal information necessary to provide the Service.
- The Company does not collect information needed for purchase contract performance at account registration unless it is necessary.
- When collecting or using personal information, the Company notifies the user of the purpose and obtains consent.
- The Company does not use collected personal information for purposes outside the stated purpose. If a new purpose arises or information is provided to a third party, the Company will notify the user and obtain consent as required.
Article 10. Company Obligations
- The Company will not engage in conduct prohibited by law or these Terms and will make efforts to provide the Service continuously and reliably.
- The Company will maintain security systems to protect personal information so users can safely use the Service.
- The Company will not send commercial advertising emails that users do not want to receive.
Article 11. Member Obligations
Members must not engage in the following conduct:
- Providing false information during application or changes
- Misusing another person's information
- Changing information posted by the Company
- Sending or posting information not designated by the Company, including computer programs
- Infringing intellectual property rights of the Company or a third party
- Damaging the reputation or interfering with the business of the Company or a third party
- Publishing or posting obscene, violent, or otherwise unlawful or harmful messages, images, audio, or other information
Article 12. Copyright and Use Restrictions
- Copyright and other intellectual property rights in works created by the Company belong to the Company.
- Users may not reproduce, transmit, publish, distribute, broadcast, or otherwise use Company-owned information obtained through the Service for commercial purposes without prior approval from the Company, and may not allow a third party to do so.
- If the Company uses copyright belonging to a user under an agreement, the Company will notify that user.
Article 13. Dispute Resolution
- The Company establishes and operates a damage compensation handling body to reflect legitimate user opinions or complaints and compensate damage.
- The Company will prioritize complaints and opinions submitted by users. If prompt handling is difficult, the Company will notify the user of the reason and processing schedule.
- If an e-commerce dispute arises between the Company and a user and the user applies for damage relief, the parties may follow mediation by the Fair Trade Commission or a dispute mediation organization requested by a city or provincial governor.
Article 14. Jurisdiction and Governing Law
- Lawsuits related to e-commerce disputes between the Company and users will be filed with the court having jurisdiction over the user's address at the time of filing, or residence if there is no address. If the user's address or residence is unclear or the user lives outside Korea, the lawsuit will be filed with the competent court under the Civil Procedure Act.
- Korean law governs lawsuits between the Company and users.
Supplementary Provision
These Terms take effect on January 1, 2025.
